Will Warsaw finally get rid of advertising?

This is another approach to the topic of a landscape resolution for Warsaw. The previous document, passed in 2020, was repealed by Governor Konstanty Radziwill. City Hall is launching consultations on a new version of the resolution.

Talks with residents on the provisions of the law limiting spatial chaos in the capital are to begin on February 24. A draft of the resolution on the rules and conditions for the location of small architectural objects, billboards and advertising devices and fences will be made available for public review. It is commonly referred to as a landscape resolution. All this in accordance with the Law on Spatial Planning and Development. Irregularities related to the mode of adoption and public consultations were, moreover, cited as the reason for the resolution's repeal by the Mazovian Voivode.

The Landscape Resolution is a comprehensive document adopted by the Warsaw City Council, for the first time realistically organizing the subject of all kinds of advertising in the capital's public space. The draft resolution will thus be consulted for the third time. The first time the proposed provisions saw the light of day was in 2017, arousing great public interest at the time. In 2018, the updated document was put out for public scrutiny under the statutory procedure. After considering comments, the draft resolution was submitted to the Warsaw City Council. The councilors almost unanimously adopted the document on January 16, 2020.

According to the Governor, the requirement for consultations was not fulfilled and procedures were violated in this regard, as well as specific provisions of the resolution were said to be in conflict with applicable law. The resolution was repealed. Courts of successive instances dealt with the case for years to come. In November 2021, the Supreme Administrative Court dismissed the governor's complaint against the first instance court's verdict, ending a years-long dispute. The governor had accused the Warsaw Council of wanting to restrict advertising more than the law allowed. However, the court substantively agreed with the city. At the same time, the WSA ruled that during the work on the resolution, the city authorities introduced changes that required a second, third public consultation and further agreements (including with the conservator of monuments).

Public consultations will last from February 24 to March 31, 2023.
